- Definitions
This section defines the key terms used in the GTC:
- Service: All functions and services provided by the "Babysitting.lu" platform, aimed at connecting parents and babysitters for babysitting activities.
- Platform: The website https://www.babysitting.lu with all its technical functions and content.
- Babysitter: All users registered under the "Babysitter" profile.
- Parents: All users registered under the "Parents" profile or otherwise using the platform's functions.
- User: Any person who uses any aspect of the "Babysitting.lu" platform.
- Operator: The platform https://www.babysitting.lu is managed by Elisabeth Jeunesse Anne Asbl, 25 ZAC Klengbousbierg, L-7795 Bissen, Tel: +352 45 07 74 - 6041.
- Partners: Organizations supporting the service on a local, regional, and national level.
- Conditions for Access to the Platform
The use of the "Babysitting.lu" platform is free of charge and requires reading and accepting these GTC and the attached Babysitting.lu Charter. In the event of non-compliance, misuse, or violations of the rules set out in these documents, the operator reserves the right to deny users access, suspend their account, or take legal action.
The user agrees to provide truthful information and to keep it up to date in case of changes in their situation. As the user account is strictly personal, the user must not share it with another person and must keep his or her login details confidential.
- Exclusion of Liability
The operator does not guarantee uninterrupted availability or error-free operation of the platform and reserves the right to modify, maintain, or suspend the platform at any time.
Babysitting.lu merely provides a platform for contact facilitation. The operator and its partners are not liable for damages, inconveniences, or conflicts resulting from the use of the service, particularly for incidents occurring during a babysitting engagement.
The operator does not interfere at any point in the contractual relationship between users (parents – babysitter). Users are solely responsible for complying with legal regulations, particularly social and tax obligations.
The operator does not verify the personal or professional qualifications of registered users and assumes no responsibility for their behavior.
- Data Protection and Data Usage
In accordance with the General Data Protection Regulation (GDPR), personal data such as name, first name, address, email, phone number, and IP address are required to enable platform use, based on contractual obligations for the purpose of customer management and contact.
The platform may publicly display the following data:
- First name
- Place of residence
- Age
- Spoken languages
- Availability (time and location)
- Profile photo (if uploaded)
Providing the data listed in points 4 to 6 is voluntary. For these voluntary details, users can withdraw their consent at any time, but this may limit the use of certain platform functions.
User data is stored as long as the person remains active on the platform or for a maximum of one year without activity or login.
The data may be shared with other users, local partners (municipalities or other contracted or state providers), or authorities in the case of a criminal investigation.
In accordance with the GDPR, any user may request access to, correction of, or deletion of their data by directly accessing their account or submitting a written request to the operator.
- Additional Information
- Rate: The babysitter and parents agree on an hourly rate together. It’s recommended that both parties agree before the service is performed. The platform does not issue invoices and is not involved in transactions between users.
- Feedback: The operator may collect feedback from users to ensure service quality, or a user may report inappropriate behavior by another user or a violation of public order or respectful conduct to the operator.
- Photos: Uploaded profile photos are visible only to registered and confirmed users.
- Applicable Law and Jurisdiction
If any clause of the GTC is declared invalid, only the clause in question shall be considered void; the rest of the GTC remains valid.
The GTC and, more generally, the relationship between the user and the platform are governed by Luxembourgish law. In case of a legal dispute, only the courts in Luxembourg City shall have jurisdiction.
- Modification of the General Terms and Conditions
The operator reserves the right to adapt these GTC at any time. Users will be informed of significant changes via email or on the platform. Continued use of the platform constitutes acceptance of the updated terms.
